John Locke and personal identity: an impasse concerning justice

چکیده

In the chapter "Of Identity and Diversity" of An Essay Concerning Human Understanding, Locke claims that justice is based on personal identity consciousness. However, this view leads to an impasse when defendant alleges he has no consciousness crime and, therefore, does not identify himself as person who committed crime: if it possible determine one crime, can we say punishment just? This article seeks (i) analyse exploring (a) its conceptual framework (b) development in letters Molyneux exchanged order (ii) elaborate a criticism Locke’s answer it. Compared secondary bibliography, which objection well established, originality consists elaborating new distinction between first third perspectives showing that, questioned by Molyneux, failed discuss issue necessary give adequate impasse.
